By using the services of Shiv Durga Logistics ("Company"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.
The Company provides surface transport, full truck load (FTL), part truck load (PTL), express parcel delivery, warehousing, packaging, distribution, corporate logistics, fleet rental, and supply chain management services. Services are subject to availability, route coverage, and applicable regulations.
All bookings must be confirmed with a purchase order, verbal confirmation, or written communication. The Company reserves the right to refuse service at its discretion. Booking confirmation constitutes acceptance of the quoted rates and these Terms.
• Rates are quoted based on weight, volume, route, and service type
• All rates are in Indian Rupees (INR) and exclusive of GST unless stated
• Payment terms are as agreed in the service agreement or invoice
• Late payments may attract interest charges as per applicable law
• The Company reserves the right to revise rates with 7 days' notice for ongoing contracts
• The Company's liability is limited to the declared value of goods as stated in the consignment note (LR)
• The Company is not liable for indirect, consequential, or special damages
• Cargo insurance is available at additional cost; clients are advised to obtain appropriate coverage
• Claims for damage must be filed within 48 hours of delivery with supporting evidence
• The Company is not liable for delays caused by acts of God, strikes, natural disasters, or government actions
The following items are prohibited from transportation:
• Illegal substances, drugs, or contraband
• Weapons and ammunition without proper authorization
• Hazardous chemicals not declared in advance
• Perishable goods without advance arrangement
• Items restricted by government or carrier regulations
Shippers are responsible for accurate declaration of goods. Undisclosed restricted items may result in seizure and legal action.
Clients are responsible for proper packaging of goods for transport. The Company may decline to accept poorly packaged goods. We are not liable for damage resulting from inadequate packaging by the shipper.
Transit times provided are estimates only and may vary due to traffic, road conditions, weather, or regulatory requirements. The Company will endeavor to meet committed timelines but does not guarantee delivery by specific dates unless explicitly agreed in writing.
If the consignee is unavailable at the delivery address, goods will be held at our nearest depot for a maximum of 7 days. Storage charges may apply thereafter. Unclaimed goods may be disposed of as per applicable law.
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Kolkata.
